Real-estate Brokerage

A case was filed by the Defendant against our client, in which the Defendant claims OMR 100,000 given that they are partners in real-estate brokerage, they intermediated in selling a property to a person from a gulf country. The brokers in the said transaction were 4, each one was entitled to 25% of the brokerage commission, and the total value of commission was OMR 400,000, as per the court award against the purchaser.

The Primary Court approved the said claim and obliged our client to pay OMR 100,000. Afterwards, the client approached us to file an appeal against this award. We insisted on the invalidity of this Award rendered against our client for two main reasons, i.e.:

  1. The Plaintiff is non-Omani, while Article 3 of the Law regulating Brokerage Business limited practicing brokerage to the establishments owned by Omanis or by GCC citizens licensed to practice real-estate brokerage.
  2. Even though an award rendered against the purchaser to pay the value of brokerage services as OMR 400,000, the said Award has not been executed. Therefore, the Appeal Court dismissed the case due to the above-mentioned grounds.
